Did Delima Falsify Notarization on Affidavits? Calida Said Yes

Human rights activist and lawyer Leila de Lima has been accused of falsifying notarization on affidavits. De Lima claimed that The Office of the Solicitor General (OSG) is so desperate and she already filed a petition seeking for her release. However, Solicitor General Jose Calida now wants to dismiss her petition because he said the notarization on her affidavits were falsified.

In a manifestation filed on Monday, March 13, before the High Tribunal held oral arguments, Calida claimed De Lima falsified the notarization of her “jurats” in the verification in her petition and in the attached affidavit of merit.

A jurat is a clause at the end of the document, according to GMA News. It contains details such as date, place, and name of the person before whom it was sworn. It is also the proof that an oath was taken before an administering officer.

To explain his claims, OSG also added that the Liberal Party member and senator De Lima could not have personally appeared and sworn before Atty. Maria Cecile Tresvalles-Cabalo to sign and execute her Verification and Certification Against Forum Shopping and the Affidavit of Merit on February 24, the day she was arrested and detained at the Philippine National Police (PNP) Custodial Center in Camp Crame for illegal drug trading.

He also cited cited affidavits of PNP Custodial Unit chief Supt. Arnel Apud and PNP Criminal Investigation and Detection Group-National Capital Region chief Supt. Belli Tamayo who was reported to have not witnessed De Lima appear and swear before Tresvalles-Cabalo on that day.

"Therefore, contrary to the allegations in the jurats, petitioner (De Lima) did not appear and swear before Atty. Tresvillas-Cabalo on February 24, 2017 in Quezon City," the manifestation stated.
