A recent job post on Villarica Pawnshop Facebook page, providing their job requirements, has angered netizens because of possible discrimination.
The job post includes basic requirements such as:
- must be a graduate of any four-year course;
- must have good moral character; and
- must be hardworking with pleasing personality.
However, the following additional requirements caused some netizens to raise eyebrows and question the legality of what the local pawnshop is looking for in their new hires.
- must be single with no child
- must be 24 years old and below.
"Bring the ff requirements:
1. Resume
2. Original and photocopy of Official Transcript of Records for female applicants only."
A netizen suggested to have the Facebook post be taken a screenshot of and send to DOLE for discrimination.
Other netizens were questioning why having a child is not allowed. Most other Facebook users point out the discrimination in the job post.
Villarica Pawnshop, has the following canned response to all the negative comments their job post received:
"We would like to thank those who have posted their positive comments on our last week post on HIRING. In response to different reactions we receive about the age qualification, it is important because we promote from within so everyone who starts working for us will have a chance to the highest position and it takes time to develop their skills. As for being single without kids, it is to increase the chance of mobility. The less family ties, the greater the chance that they would be willing to be assigned to different branches all over the country."
In the light of fairness, Scoop.ph has taken the initiative to check on the legal aspect when it comes to work discrimination and we have found the following:
*** Section 2(a) states that:
Promote employment of individuals on the basis of their abilities, knowledge, skills and qualifications rather than their age.
*** Section 2(b) states that:
Prohibit arbitrary age limitations in employment.
*** Section 2(c) states that:
Promote the right of all employees and workers, regardless of age, to be treated equally in terms of compensation, benefits, promotion, training and other employment opportunities.
#2: Republic Act No. 9710 - An Act Providing for the Magna Carta of Women
*** Chapter II Section 4(b) states that:
“Discrimination Against Women” refers to any gender-based distinction, exclusion, or restriction which has the effect or purpose of impairing or nullifying the recognition, enjoyment, or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil, or any other field.
#3: Republic Act 8972 - An Act Providing for Benefits and Privileges to Solo Parents and Their Children, Appropriating Funds Therefor and For Other Purposes
*** Section 7 states that:
No employer shall discriminate against any solo parent employee with respect to terms and conditions of employment on account of his/her status.
What's your stand on this? Is Villarica Pawnshop clearly discriminating applicants based on (1) age, (2) gender, and (3) against solo parent women, or is the company simply protecting its interest?
