Civil Rights Group Claims that Banning Porn Sites is Illegal. Find Out Why?


It was in mid-January when the Philippine National Police Anti-Cybercrime Group (PNP-ACG) blocked 21 adult websites in their pursuit to shut child pornography in the country. 


Pierre Tito Galla, co-founder of Democracy.Net.PH, claimed on Wednesday that efforts made by PNP-ACG may have taken shortcuts by failing to get a court order before banning porn sites. 

PNP, NTC and Department of Information and Communications Technology will face certiorari and contempt charges for their failure to secure one before implementing such actions.

Galla, expressing their utmost support for PNP's continued efforts to eradicate child trafficking online, however noted that they had not presented any order from the Supreme Court.


The Supreme Court provided in their ruling on the Cybercrime Prevention Act of 2012 that "the blocking or takedown of any online content requires compliance with judicial processes."

Even the secretary of justice is still not authorized to block access to any website, may it be connected to cyber crime or not, for such act is unconstitutional. 

Restricting freedom of expression over cyberspace, the court decision also states that anyone who would seize content without judicial warrant will by-pass the job ordained to a judge and an executioner.
